Intellectual Property Policy
Quantum Leaf is dedicated to creating knowledge boosters in future technology that empowers professionals to learn & apply skills to their jobs. Our platform provides a knowledge network for business professionals in future skills. In providing these learning services Quantum Leaf is respectful of the intellectual property rights of others. We take the safeguarding of intellectual property rights, both ours and third parties seriously. Infringing activity is not tolerated on or through the Quantum Leaf platform.
In our agreements with our content providers (Content Owners) we require that their courses, presentations and content be lawful and accurate at all times and do not infringe any other party’s intellectual property rights. Content Owners are also required to obtain all authorizations and licenses necessary to use the content contained in their courses and presentations. Quantum Leaf does review and edit the course content but not in relation to legal issues including intellectual property ownership rights. We are not able to determine legal ownership of the courses and content.
This policy provides information about intellectual property rights (IPR) and common IPR concerns when using Quantum Leaf services and subscribing to courses on the Quantum Leaf website. This policy also provides details of our IPR complaints process concerning content posted on our website. Quantum Leaf’s IPR Policy does not purport to provide or contain legal advice and you should seek legal advice if you have a specific question about IPRs.
This policy addresses the action we take in the event of:
- copyright infringement complaints from third parties in relation to information and courses posted on the Quantum Leaf website;
- the copying of Quantum Leaf courses by third parties platforms without our consent; and
- trademark infringement claims from third parties;
- other IPR complaints.
Copyright Infringement – Complaints relating to material on Quantum Leaf’s website infringing a third party copyright.
1. Submitting a complaint
- If you are the copyright owner of the content that you believe is infringing your copyright please notify Quantum Leaf by sending an email detailing the complaint to [email protected]. We are only able to process complaints from the copyright owner and may ask for such information as we require necessary to establish that you are the owner of the copyright. A copy of your compliant will be sent to the Content Owner who posted the content the subject of your complaint.
- We are not able to process any complaints that are not sufficiently substantiated. This means that we need your full contact details, sufficient evidence that the material is subject to copyright owned by you and clear details of which component of the course you allege infringes your copyright. We will notify you if we are unable to proceed with the complaint due to your failure to provide us with sufficient information. You consent to a copy of your complaint being sent to the Content Owner who posted the content the subject of your complaint.
- Prior to submitting a complaint, we request that you; consider the right of the Content Owner to use the material under the “fair use” exception. In certain circumstances it is permissible by law to use copyrighted content if it is for fair use reasons such as in the public interest, for reporting news and current affairs, research, commentary and critical analysis. Ensure that the material is entitled to copyright protection. Some material is not covered by copyright protection such as names, titles, slogans, processes, ideas and facts.
- It is against the law to knowingly submit a false or misleading claim of infringement. We require that when sending complaint to us that you include a statement confirming that your compliant is genuine, accurate and made in good faith and that you are the copyright owner or authorised to act on the copyright owner’s behalf and that the complaint is being submitted under penalty of perjury. Quantum Leaf reserves the right to seek damages from you if you submit a complaint in violation of the law.
2. Actioning a copyright infringement complaint
- Upon receipt of a valid copyright infringement complaint from the owner of the copyright Quantum Leaf will take such steps as it deems appropriate to review the matters raised in the complaint. We will notify the relevant Content Owner that we have received the complaint and provide he/she the opportunity to respond to Quantum Leaf in respect to the matters raised the complaint.
- In the event that Quantum Leaf determine that it is appropriate it may either remove the content from its website and no longer make the content or course available or require the Content Owner to make changes to address the Complainant’s concerns.
- If the Content Owner believes that the content or course should not be removed due to reasons such as that he/she has valid consent to use the material then the Content Owner may send to Quantum Leaf a counter-notice.
- We are not able to process any counter-notices that are not sufficiently substantiated. This means that we need sufficient details as to why you believe the content should not be removed from the Quantum Leaf website and does not infringe another’s copyright and evidence that the material is subject to copyright owned by you.
- As part of the counter-notice Quantum Leaf requires that the Content Owner provides written consent to us sharing your contact details with the complainant.
- Any counter-notice submitted must be truthful and must be submitted under penalty of perjury. A counter-notice containing false information or statements may give rise to personal liability and you should consider obtaining legal advice before submitting a counter-notice.
- Quantum Leaf reserves the right to determine that there has been no copyright infringement and take no action or to take such other action as it deems appropriate such as requiring the Content Owner to make changes to the content. Quantum Leaf will notify the Complainant and the Content Owner of its decision.
Copyright Infringement – Complaints relating to infringement by third parties of content and material on Quantum Leaf’s website.
Quantum Leaf recognises the importance of protecting the copyright in the content and material posted by its Content Owners on its website and used to provide the services. If you a Content Owner and owner of the copyright in the material you have posted on the Quantum Leaf website and you become aware of infringing activities in relation to your copyright we request that you notify us immediately following the process set out in this section.

- If you are a Content Owner and the copyright owner of the content on the Quantum Leaf website that you believe is being infringed, please notify us by sending an email detailing the infringement details to [email protected]. We are only able to process notifications from the copyright owner. We may ask for such information as we require necessary to establish that you are the owner of the copyright.
- We are not able to process any complaints that are not sufficiently substantiated. This means that we need substantive evidence that the copyright is owned by you, clear details of which component of the course or material you allege is being infringed and the details of the person that you allege is infringing your copyright. We will notify you if we are unable to proceed with the complaint due to your failure to provide us with sufficient information.
- It is against the law to knowingly submit a false or misleading claim of infringement. We require that when sending complaint to us that you include a statement confirming that your compliant is genuine, accurate and made in good faith and that you are the copyright owner or authorised to act on the copyright owner’s behalf and that the complaint is being submitted under penalty of perjury. Quantum Leaf reserves the right to seek damages from you if you submit a complaint in violation of the law.
2. Actioning a copyright infringement complaint
- Upon receipt of a valid copyright infringement complaint Quantum Leaf will take such steps as it deems appropriate to review the matters raised in the complaint. This may include issuing infringement notices and cease and desist notifications and taking legal action to have the content removed on the third party platform.
- Whilst Quantum Leaf will take such action as we deem appropriate, we do not control the postings on other websites. We cannot guarantee that the infringing party will comply with our notices and complaints and we may not always be successful in removing the content from other sites and preventing any further infringement activities.
Trademark Infringement – Complaints relating to material on Quantum Leaf’s website infringing a third party trademark.
1. Submitting a complaint
- If you are the trademark owner and believe material posted on the Quantum Leaf website is infringing your trademark rights, please notify us by sending an email detailing the complaint to [email protected]. We are only able to process complaints from the trademark owner and may ask for such information as we require necessary to establish that you are the owner of the trademark such as trademark registration details. You consent to a copy of your complaint being sent to the party who posted the content the subject of your complaint.
- We are not able to process any complaints that are not sufficiently substantiated. This means that we need your full contact details, sufficient evidence that you own the trademark and clear details of which component of the course you allege infringes your trademark rights. We will notify you if we are unable to proceed with the complaint due to your failure to provide us with sufficient information.
- We also need an exact copy of the mark registered as trademark, the registration number, details of the country in which you claim trademark rights and the category of goods and/or services for in respect to which your trademark has been registered.
- Prior to submitting a complaint we request that you consider the right of another person or company to use the material under the “fair use” exception which allows others to use a trademark in the course of factually referencing a product or service or commenting on the trademark. Trademark law is designed to prevent consumer confusion between products and services and we request that you consider whether the reference to your trademark is likely to have caused confusion with the public as to who has created, owns, endorsed or is affiliated with the course and its content.
- It is against the law to knowingly submit a false or misleading claim of infringement. We require that when sending complaint to us that you include a statement confirming that your compliant is genuine, accurate and made in good faith and that you are the trademark owner or authorised to act on the copyright owner’s behalf and that the complaint is being submitted under penalty of perjury. Quantum Leaf reserves the right to seek damages from you if you submit a complaint in violation of the law.
